Your SAP’s work has to hold up
Choosing a SAP is not like shopping for the lowest price on tires. Your evaluation, your SAP reports and your Clearinghouse entries are reviewed by your employer, by C/TPAs and, during audits, by DOT. If any of it is done wrong, the problem lands on you.
What a careless or unqualified SAP can cost you
- Starting over. If the person is not a qualified SAP under 49 CFR 40.281, or the evaluation was not done face to face (in person or by live video), it may not count. You pay again and wait again.
- No do-overs. DOT rules do not allow you to get a second SAP evaluation because you want a different recommendation (49 CFR 40.295). Choose carefully the first time.
- Delays getting back to work. Incomplete reports, missing information or Clearinghouse errors can hold up your return-to-duty test while your employer sorts it out.
- Problems that surface later. An employer audit or compliance review can turn up a return-to-duty process that was not done right, putting your job and your employer’s compliance record at risk.
- A SAP who disappears. DOT can bar service agents who seriously fail to follow the rules. If that happens mid-process, you are left scrambling.

The one thing that makes this harder is waiting. Since November 2024 an unresolved violation puts your licence itself at risk, so the sooner you start, the sooner it is behind you.
CAUTION: Not every substance abuse counselor is a DOT SAP. Only a DOT-qualified Substance Abuse Professional can do the evaluations you need before your return-to-duty test. Ask for credentials before you pay. Every DFW SAP evaluation is done by a DOT-qualified SAP and follows 49 CFR Part 40.
SCAM ALERT: Be careful with anyone who contacts you first about your violation, promises guaranteed clearance, or will only take payment through an app like Zelle or Cash App with no other option. Read the warning signs before you pay or designate a SAP.
